Nursing sibling filing lawsuit against brother for firing her from Scottish doctor's practice during pregnancy
In a surprising turn of events, Anika Moughal, a former practice nurse at Greenlaw Medical Practice, is taking legal action against her brother, Dr Mohammed Moughal, and the GP practice for unfair dismissal.
Anika, who joined Greenlaw Medical Practice in September 2020, had previously worked at the practice as a receptionist in 2013 and as a healthcare support worker from 2014 to 2018. However, her employment came to an end under controversial circumstances, as she was dismissed while she was pregnant.
During her pregnancy, which was described as "complicated," Sandra Grant, the Greenlaw manager, asked Anika to carry out less in-person clinics. This request coincided with the practice's shift in focus towards digital and remote healthcare services.
Despite working mostly remotely and managing patients with chronic diseases, Anika received a P45 by August that year, signalling her termination. However, she claims that her brother was "objectively ambiguous" when informing her of her dismissal, using terms like "stop working" and "stop logging in," but not "terminated," "dismissed," or "fired."
Moreover, there was no letter or email confirming the termination of Anika's employment in writing. The decision to sack Anika was made on July 31, 2024, but the details about why were not revealed.
Anika was unaware that the payments of her salary would be permanently stopped after April 2024. The tribunal concluded that Anika was an employee, she was dismissed, and the employment tribunal had jurisdiction to hear her claims.
Greenlaw Medical Practice, which has locations in Newton Mearns, East Renfrewshire, and Pollokshields, has since dissolved following a dispute between the partners. The tribunal found that Anika was sacked on July 31, 2024.
Anika's case will be considered in full by an employment tribunal at a later date. She is suing her brother and his GP practice for unfair dismissal.
