The investigation into the suspected negligent homicide at Petrus Hospital, which stemmed from the death of a 36-year-old man from pneumococcal meningitis after discharge, has concluded with no criminal charges being attributed to the accused chief physician.

The patient, who had initially sought treatment at Petrus Hospital's emergency room on January 17, 2022, due to chest pain, joint pain, a weakened overall condition, and a loss of sense of smell and taste caused by COVID-19, was discharged from the hospital after an examination. However, his health deteriorated on January 22, 2022, and he sought medical attention at the emergency practice of the Association of Statutory Health Insurance Physicians on the grounds of Petrus Hospital.

Despite the efforts of the medical team, the patient was later admitted to Helios Clinic in Wuppertal and died on January 25, 2022, from the consequences of pneumococcal meningitis. This led to an investigation into suspected negligent homicide.

However, the investigation proceedings have been discontinued due to the lifting of the suspicion of a crime. Chief Prosecutor Wolf-Tilman Baumert stated that a criminal complaint was filed following a family member's complaint. Despite the thorough investigation, no new information was found to suggest negligence on the part of the chief physician.

The results of expert opinions commissioned during the investigation showed that the timely administration of antibiotics could have potentially saved the patient's life, but by the time pneumococcal meningitis was recognized, it was too late.

This case is part of broader probes into fatal neglect and mismanagement at Northern Cape psychiatric and general hospitals, including the Northern Cape Mental Health Hospital (NCMHH) and Robert Mangaliso Sobukwe Hospital (RMSH). Official investigations by the Health Ombud have found gross mismanagement and fatal negligence at these facilities, including inadequate patient monitoring, malfunctioning or unavailable resuscitation equipment, and poor infrastructure.

Following the Ombud's report, the Minister of Health has announced the formation of a National Mental Health Review Committee tasked with reviewing governance, investigating failures, and implementing reforms across mental health facilities. Additional funding of R6.7 billion has been allocated for healthcare improvements, including hiring more medical staff and upgrading essentials like beds and equipment.

The Congress of the People (Cope) has additionally opened a murder case at Kimberley Police Station and is pressing for criminal accountability, with investigations continuing and reviews by the Hawks and legal teams underway.
